Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DDM platform and website (the "Service"), operated by DeepDive Media Private Limited, a company incorporated in India with registered office at 4th Floor, Balaji Tech Tower 2, A-28C, Industrial Area, Sector 73, Sahibzada Ajit Singh Nagar, Punjab 160055. By using the Service, you agree to these Terms.

1. Acceptance

By accessing or using the Service, you agree to be bound by these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Service.

2. The Service

DDM provides tools for advertising agencies and media buyers to launch, automate, and report on Meta advertising campaigns across connected Business Managers. Access is provided on an invite-only basis following an onboarding process.

3. Eligibility & accounts

• You must be at least 18 and able to form a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or any third-party platform's terms, including Meta's policies.
• Attempt to gain unauthorized access to the Service or other users' data.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer or resell the Service without authorization.

5. Meta platform compliance

The Service interacts with Meta's APIs. Your use must comply with Meta's Platform Terms, Developer Policies, and Advertising Standards. You are responsible for the campaigns and content you run through your own ad accounts. DDM is not affiliated with or endorsed by Meta Platforms, Inc.

6. Your responsibilities

• You retain ownership and control of your ad accounts and budgets; ad spend is billed by Meta directly to your accounts.
• You are responsible for the rules and automations you configure and their effects on your campaigns.
• You must ensure you have the rights to connect the Business Managers and assets you add.

7. Fees

Paid plans are billed in advance on the cycle shown at purchase. Fees are for the DDM subscription only and do not include your Meta ad spend. Unless required by law, fees are non-refundable.

8. Intellectual property

The Service, including its software, design, and content, is owned by DeepDive Media Private Limited and protected by law. You retain all rights to your data. We claim no ownership over your campaigns or advertising content.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee specific advertising results, uninterrupted availability, or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, DeepDive Media Private Limited will not be liable for indirect, incidental, or consequential damages, or for advertising outcomes. Our total liability is limited to the amount you paid for the Service in the preceding twelve months.

11. Termination

You may stop using the Service and disconnect your accounts at any time. We may suspend or terminate access for breach of these Terms or to protect the Service. On termination, you may request export or deletion of your data.

12. Governing law & changes

These Terms are governed by and construed in accordance with the laws of India. Courts at DeepDive Media Private Limited's registered office shall have exclusive jurisdiction over any disputes arising from these Terms. We may update these Terms; material changes will be posted here with an updated date.
